The U.S. SEC is not investigating either OHL or any of its subsidiaries, particularly OHL México
October 27, 2016
In relation to the information reported by a Spanish news organization in its paper edition today, with respect to an alleged investigation of OHL by the SEC in the United States on account of the purchase of specialized equipment from the listed company, Barrier Systems Sales and Service LLC, the OHL Group firmly denies such information and states as follows:
- Neither OHL nor any of its subsidiaries, particularly OHL México SAB de CV, is being investigated by the U.S. stock exchange authority.
- The Mexican subsidiary of Barrier Systems Sales and Service LLC was one of the hundreds of suppliers of OHL México in the performance of the Bicentennial Viaduct concession in Mexico D.F., and the relationship with that company was absolutely legal, transparent and legitimate and, of course, was supervised by the auditors and by the concession grantor.
- This information is set is the framework of the defamatory campaign that OHL México has been suffering since 2013 organized by the company, Infraiber. Mexico’s National Banking and Securities Commission, following more than an entire year of investigation of the activities of OHL México, determined last March the absolute legality of its toll road concessions. In August, the Mexican Supreme Court of Justice of the Nation also determined the legality of OHL México’s concessions in the face of another claim connected with that campaign.
